Related services and offerings with links from this website, including vendor sites, have their own privacy statements that can be viewed by clicking on the corresponding links within each respective website. Since we do not have direct control over the policies or practices of participating merchants and other third parties, we are not responsible for the privacy practices or contents of those sites. We recommend that you always review the privacy policies of merchants and other third parties before you provide any personal information or complete any transaction with such parties.

Information We Collect And How We Use It

This section of our Policy describes in detail the type of information that we collect. We collect information from you in various ways when you access or use the Site, various services, and/or our mobile applications (the “Services”).

Much of the personal information collected through the Services is voluntarily submitted by you. For example:

Account Information. We may collect personal information from you, such as your first and last name, email address, telephone number, date of birth, zip code, mailing address, and password or other unique identifier, when you create an account for one of our programs, e.g., our Pickle Points or other loyalty or rewards program (“Account”).

Location Information. If you tell us where you are (e.g., by allowing your mobile device to send us your location or by entering your city, state and/or zip code information), we may collect information about your location and use that information to provide you with location-based information, such as the location of our restaurants near you. If you want to deactivate this feature, you can deactivate location services on your mobile device.

Store Preference Information. Our online order services may allow you to store preferences such as your location, recent orders and favorite menu items in order to make it more convenient for you to place additional orders in the future.

Online Ordering Information. When you order our Services online (e.g., menu items or gift cards), we will collect information to complete the transaction, including potentially: your name; email address; billing, shipping and delivery addresses; and payment information such as credit card number. We store this information (excluding credit card numbers) in order to make it easier for you to place orders in the future. We also collect information regarding the items you place in a basket, items you purchase, your time of visit and preferred store locations.

Favorite Location Information. Our website allows you to save a preferred restaurant location as a “favorite.” When you select a favorite location, basic information about that restaurant — such as its name and a link to its order page — is stored directly in your browser’s localstorage. This information is used solely to provide you with convenient quick links to your favorite location, including a popup on our homepage and a banner displayed across all pages on the “Site”.

This information is stored locally on your device and is not transmitted to our servers or shared with any third-party services. No personal or identifying information is collected through this feature. Your favorite location will remain saved until you choose to remove it by de-selecting the location on our website, or by clearing your browser’s cache or local storage through your browser settings.

Web Server Logs. When you visit our Site, we may track information to administer the Site and analyze its usage. Examples of information we may track include:

Personal Information Provided By Users. Visitors to our Site can register to purchase services. If you are purchasing a service, we will request financial information. Any financial information we collect is used only to bill you for the services you purchased. If you purchase by credit card, this information may be forwarded to your credit card provider. For other types of registrations, we will ask for the relevant information. Mobile Information. Any information that you provide when registering for mobile messaging will not be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Use Of Web Beacons. Our email communications may contain electronic images known as Web beacons, in order to determine whether messages have been opened and acted upon.

Some of these Web beacons may be placed by third-party service providers to help determine the effectiveness of our advertising campaigns or email communications. These Web beacons may be used by these service providers to place a persistent cookie on your computer. This allows the service provider to recognize your computer each time you visit certain pages or emails and compile anonymous information in relation to those page views, which in turn enables us and our service providers to learn which advertisements and emails bring you to our Site and how you use the Site. Right to Delete Information

California residents have the right to request that we delete your personal information, subject to certain exceptions. Once we receive and verify  your request, if we determine no exception applies, we will delete (and direct our service providers to delete) your personal information from our records. 

We may deny your request if retaining the information is necessary for Mr. Pickle’s or its service providers to:

  • complete the transaction for which we collected the personal information; provide a good that you requested; take actions reasonably anticipated within the context of our ongoing business relationship with you; 
  • detect security incidents; protect against malicious, deceptive, fraudulent or illegal activity or prosecute those responsible for such activities; 
  • debug products to identify and repair errors that impair existing intended functionality; 
  • exercise free speech; ensure the right of another consumer to exercise their free speech rights; or exercise another right provided for by law; 
  • comply with the California Electronic Communications Privacy Act (Penal Code, § 1546 et seq.)
  • engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when the information’s deletion may render impossible or seriously impair the research’s achievement, if you previously provided informed consent;
  • enable solely internal uses that are reasonably aligned with consumer expectations based on your interactions with us; 
  • comply with a legal obligation; or 
  • make other internal or lawful uses of that information that are compatible with the context in which you provided it.

How to Exercise Rights

To exercise your rights under California law, a resident must submit a verifiable consumer request to us by either: calling us at 855-677-4255 x1 or via our contact form.

The person making the request must:

  • provide sufficient information to allow us to verify that the person submitting the request is the person, or the authorized representative, of the person whose personal information is implicated by the request. 
  • describe the request with sufficient detail to allow us to properly understand, evaluate, and respond to it. 

Only a California resident, or a person authorized to act on the resident’s behalf, may make a consumer request to Mr. Pickle’s related to the resident’s personal information. A California resident may also make a consumer request on behalf of their minor child. 

We cannot respond to a request if we cannot verify the consumer’s identity or the requestor’s authority to make the request. You do not have to create an account to submit a consumer request. We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request. 

Response Timing and Format

If a California resident sends a verifiable consumer request as set forth above, we will respond within 45 days. If we need additional time, we will inform the person making the request of the reason for the extension and the length of the extension. We will deliver our written response by e-mail.

Any disclosures we provide will only cover the 12-month period preceding receipt of the verifiable consumer request. Alternatively, the response will explain the reasons we cannot comply with a request. 

For data portability requests, we will provide the sought-after personal information in a form that is readily useable and should allow the consumer to transmit the information from one entity to another entity without hindrance. 

We do not charge a fee to process or respond to a verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell the requestor why and provide the requestor with a cost estimate before completing the request. 

Non-Discrimination Notice

Mr. Pickle’s will not discriminate against any consumer for exercising any of their rights under California law. Unless permitted by law, if a consumer exercises any of their rights under the California Consumer Privacy Act, we will not:

  • Deny the consumer goods or services; 
  • Charge the consumer different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties; 
  • Provide the consumer a different level or quality of goods or services; or 
  • Suggest that the consumer may receive a different price or rate for goods or services or a different level or quality of goods or services. 

OTHER WAYS TO LIMIT USE OF PERSONAL INFORMATION

Unsubscribe from Emails and Other Communications

If you provide us with personal information and, thereafter, do not want to continue to receive further notices or information from us, such as emails about our products or services, you may unsubscribe using the link at the bottom of our emails or texting STOP to 480-680-7383 to unsubscribe from text message campaigns.
